Six year old girl receives €30,000 after knee injury

A six-year-old girl who suffered a “nasty” cut to her knee during gymnastics has been awarded €30,000 damages.

Kevin D’Arcy, counsel for Holly Murray, told Judge Eoin Garavan in the Circuit Civil Court she had been working on a trampoline in May 2017.

Mr D’Arcy, who appeared with Niall Corr Solicitors, said it happened at a gym class at Leader Academy, Feltrim, Kinsealy, Dublin, where a wall mirror was cracked and supported by tape. When her mother, Glenda Murray, arrived at the gym she found the cut bleeding profusely.

Mr D’Arcy said Ms Murray was told Holly had fallen, suffering two cuts, one very deep. It was not known if the injuries were caused by mirror glass or a protruding metal bolt.

He told the court Holly, of Drynam Drive, Kinsealy, Co Dublin, was brought to the VHI clinic near Swords and needed five stitches.

Counsel said the Irish Gymnastics Company, which trades as Gymnastics Ireland at the National Sports Campus, Blanchardstown, had offered Holly a settlement of €25,000 which he considered light although he recommended approval.

The judge, having viewed the scar on Holly’s knee, said she would have a permanent mark and he considered the offer too low.

Following an adjournment, Mr D’Arcy said the offer had been increased to €30,000 which the judge approved and directed payment of the amount into court.
